This Act of Sederunt was made by the Court of Session on 3 September 2026 and comes into force on 5 October 2026.

It amends the Summary Cause Rules 2002, introducing new forms of claim and an extract decree proforma to support the operation of section 22 of the Domestic Abuse (Protection) (Scotland) Act 2021.

Section 22 provides a method for social landlords who have let a house under a Scottish secure tenancy to apply to the sheriff court for an order:

(1)  to recover the house let where the tenant is a sole tenant and has engaged in behaviour which is abusive of a partner or ex-partner. This is to enable the landlord to enter into a new tenancy with the partner or ex-partner who is the survivor of the abusive behaviour; or

(2)  to terminate a tenant’s interest in the tenancy where that tenant has engaged in behaviour which is abusive of a partner or ex-partner and that partner or ex-partner is a joint tenant.
