New Rules on Reporting Restrictions

An Act of Sederunt (Rules of the Court of Session 1994, Sheriff Appeal Court Rules and Sheriff Court Rules Amendment) (Reporting Restrictions) 2020 (SSI 2020/28) comes in to force on 2 March 2020.

New rules which clarify the procedures regulating the making of court orders which impose reporting restrictions across the Scottish civil courts will come into force on 2 March.

The new rules provide that in relevant proceedings, where the court is considering making a restriction order, it must first make an interim order and state the reasons why the restriction order is being considered in the case.

 There are no changes to existing rules regulating the procedure for hearings in these cases. Hearings will take place when required and will permit any interested party with an opportunity to make representations prior to a final order being made.
