A consultation has been launched today on draft rules for Protective Expenses Orders, which will run until 23 June 2017.

The draft rules seek to ensure that, where applicable, the rules regulating applications for Protective Expenses Orders (PEOs) in environmental proceedings operate so as to give proper effect to the requirement, under the Aarhus Convention and European Union Law, that proceedings should be ‘not prohibitively expensive’.

The rules, developed by the Council, propose a new procedural model for applications for PEOs.
